These Terms and Conditions govern your purchase and use of the services provided by Perth Real Estate Marketing Co. By purchasing, you agree to these Terms.
The Service
Perth Real Estate Marketing Co provides exclusive lead generation for real estate agents through targeted Facebook and Instagram advertising. Qualified seller leads are sent directly to you as they come in.
Pricing
Pricing is agreed in writing between Perth Real Estate Marketing Co. and the client prior to commencement. Clients are charged on a pay-per-result basis — you are only charged when a lead we deliver results in a settled sale, at the rate agreed in your individual service agreement. All prices are in AUD and are GST exclusive. Perth Real Estate Marketing Co is not currently registered for GST. No GST is charged on any of our services.
Payment
Invoicing details, including frequency and method, are outlined in your individual service agreement. Payments are processed via secure third-party payment processing — we do not store your payment details directly. If a payment fails or becomes overdue, you have 14 days to resolve the outstanding balance before services are suspended.
Minimum Commitment
There is no lock-in contract and no minimum commitment for standard clients. The only ongoing requirements are that you keep us updated on how each lead progresses, and that leads aren't shared with other agents. Founding clients are subject to different terms — see 'Founding Client Agreement' below.
Founding Client Agreement
Founding clients agree to provide the following within 60 days of their campaign going live: a Google review of Perth Real Estate Marketing Co, and either a written or video testimonial about their experience, and permission for Perth Real Estate Marketing Co to display their agency logo on our website and marketing materials. Within 5 business days of signing: film and upload footage using the filming guide provided, so Perth Real Estate Marketing Co can produce the client's 60-second video. Founding clients are subject to a three-month minimum commitment. Failure to provide the above does not affect payment obligations.
Setup and Delivery
Your exclusive suburb campaign goes live shortly after your application is approved. We handle setup, ad accounts, and campaign launch entirely on our end — there is nothing required from you to get started.
Cancellation
You may cancel at any time by notifying Perth Real Estate Marketing Co directly, in writing. No exit fees apply.
Refunds
As you are only ever charged when a lead results in a settled sale, there is no minimum spend and nothing to refund for a shortfall. Nothing limits your rights under Australian Consumer Law.
Your Responsibilities
Provide accurate onboarding information. Notify us of any changes to your services, pricing, or service areas.
Our Responsibilities
We will build and maintain your services as described. Update requests are responded to within 2 business days. Complex build requests may require additional time, which will be communicated to the Client upon receipt.
Limitation of Liability
Perth Real Estate Marketing Co is not liable for indirect or consequential loss. Total liability limited to fees paid in the preceding 3 months. Nothing excludes liability that cannot be excluded under Australian Consumer Law.
Intellectual Property
Systems built by Perth Real Estate Marketing Co remain our intellectual property until all fees are paid. Upon cancellation you retain rights to your business data.
Non-Disparagement
The Client agrees not to make, publish, or communicate any false, misleading, or disparaging statements about Perth Real Estate Marketing Co, its services, staff, or reputation — whether publicly (including on social media, Google, or review platforms) or privately to third parties. This clause does not prevent the Client from raising genuine concerns directly with Perth Real Estate Marketing Co or from making truthful statements in legal proceedings.
Results Disclaimer
Lead generation results depend on factors outside Perth Real Estate Marketing Co's control, including the Client's responsiveness to leads, sales ability, follow-up process, pricing, and local market conditions. Perth Real Estate Marketing Co is responsible for delivering lead generation campaigns, automation systems, and CRM setup as described in the Seller to Settlement System. Conversion of leads into listings or sales is the sole responsibility of the Client. No specific volume of leads or sales outcomes is guaranteed.
Governing Law
Governed by the laws of Western Australia, Australia. Clients outside Australia agree that any dispute will be governed by the laws of Western Australia, Australia, and consent to the jurisdiction of Western Australian courts. All prices and payment obligations are in Australian Dollars (AUD) regardless of the client's country of residence.
